Basic Function

Under general direction, performs a wide range of real property activities related to the acquisition, lease, or sale of real property, rights-of-way and easements; manages all aspects of City property leased for commercial purposes; negotiates and oversees contracts with appraisers and other consultants; provides oversight for relocation assistance; and performs related duties as assigned

Typical Duties

(May include, but are not limited to the following):
  • Develops requests for proposals (RFP’s) and contracts for appraisers and other professional consultants; reviews and evaluates proposals/contracts; negotiates and selects consultant/contractor; manages consultant and arranges for payment.
  • Prepares legal documents for acquisition, property management, and other agreements as needed, including purchase contracts, deeds, appraisal summary statements, leases, temporary and permanent easements, right of entries, possession and use agreements, escrow instructions, and licenses or permits.
  • Negotiates and manages leases for City-owned commercial property as well as leases for the City occupancy of privately-owned property.
  • Maintains a monitoring/tracking system for City-owned leased facilities.
  • Manages ongoing leases including maintaining monitoring systems; acts as tenant liaison; presents information to the City Council; negotiates modifications in rent payment structure as necessary; may develop loan and promissory notes for tenants; writes assignment agreements; responds to inquiries and requests from other City departments.
  • Maintains inventory and related records of City-owned real property.
  • Manages sale of surplus City property including developing marketing package, responds to inquiries and requests regarding availability of City property for purchase; researches property , determines potential for City use, considers proposed use by buyer; processes transaction.
  • Administers and oversees relocation obligations; evaluates acquisition of property by the City and develops relocation plan and contract if necessary and monitors implementation.
  • Negotiates with property owners to establish terms and conditions of property conveyance.
  • Periodically inspect all leased and licensed City property to ensure compliance with the terms and conditions of the agreement.
  • Prepares budget for Property Management function.
ENVIRONMENTAL AND WORKING CONDITIONS:
Position requires prolonged sitting and occasional standing, walking, kneeling, and stooping in the performance of daily activities. The position also requires fine coordination in preparing reports using a computer keyboard. Additionally, the position requires both near and far vision in reading written reports and work related documents. Acute hearing is required when providing phone and personal service.

Minimum Qualifications

(Knowledge, Skills and Abilities):
Knowledge of:
  • laws, principles, practices, procedures and standards related to commercial leasing and property management in a municipal setting;
  • terminology used in real estate transactions such as leases, rights of way, easements and escrows;
  • procedures, documents and forms utilized in property management and property sale and acquisition;
  • laws and regulations governing the purchase and sale of property by government entities;
  • property valuation procedures, concepts and techniques;
  • negotiation techniques and strategies;
  • the RFP process and contract development.
Ability to:
  • understand building plans, property descriptions, title reports, contracts, deeds, and other documents associated with property transactions;
  • communicate effectively orally and in writing, including the ability to interpret and explain policies; prepare clear and concise reports, correspondence, policies, procedures and other written materials;
  • interact effectively, courteously and tactfully with property owners, agents, representatives of outside organizations and the general public;
  • negotiate and manage commercial leases;
  • negotiate the purchase and sale of real property;
  • interpret, apply and explain laws, codes, regulations and ordinances;
  • effectively represent the department and the City in meetings with governmental agencies, community groups, various businesses, professional and regulatory organizations and individuals;
  • use personal computer based applications Microsoft Word, Excel, and Powerpoint;
  • maintain accurate records and files for effective monitoring and tracking.
Education and Experience
Any combination of education and/or experience that has provided the knowledge, skill, and abilities required is qualifying. A typical way to obtain these qualifications is:
  • A Bachelor’s Degree from an accredited college or university in Economics, Public or Business administration, or related field, or a Real Estate Broker License or Property Manager License and two (2) years of verifiable experience in the appraisal, purchase, lease and sale of real property as a right-of-way agent, property officer or real estate appraiser with a public agency, or a commercial property manager.
Licenses
  • Possession at time of hire and continued maintenance of a valid California driver’s license and safe driving record.

SALARY - The current salary range for this position is posted on the City website. Appointment may be made commensurate with experience. See the Mid-Management MOU documents on the City website for further details on pay rates and practices.
APPOINTMENT - Any candidate selected by the appointing department may be required to pass a pre-employment medical exam administered by a City-selected physician before hire to non-sedentary positions. Prior to starting work, all newly hired employees will be fingerprinted to check conviction history. A conviction history will not necessarily disqualify an applicant from appointment. Candidates must present documentation verifying authorization to work in the United States and take a loyalty oath as required by the State of California at the time of hire. Appointments to regular positions are subject to a six-month probationary period which is considered a part of the selection process. Probationary employees may be terminated without recourse during this period. Positions which are covered by the Department of Transportation regulations are required to submit to a pre-employment drug test and to random drug and alcohol testing.
LEAVE
Vacation – 80 hours/year up to 5 years, 120 hours/year 6-10 years, plus 8 hours for each year after 10 years up to a maximum of 160 hours/year.
Sick – 12 days/year
Holidays – up to 11 days/year
Floating Holidays - 24 hours per year - prorated for part-time
INSURANCE – (available to employee and eligible dependents)
Medical – Depends on plan selected; City generally pays at least 90% of the cost of coverage. Participating members make an additional $35 contribution per pay period towards health care benefits.
Dental, Vision, Employee Assistance Program – City currently pays full cost of employee and family coverage. Pro-rated for part-time.
Life – City provides a $25,000 life insurance policy.
Long Term Disability – City provides a long term disability plan.
MANAGEMENT LEAVE/OPTIONAL BENEFIT PLAN
80 hours of additional vacation per year. A $1,300 (less than 10 yrs) or $1,500 (greater than 10 yrs) annual contribution may be used to purchase additional vacation, be place in deferred compensation account or be paid in cash (cashout limited to 20 hours).
RETIREMENT
All regular employees become members of PERS. Public Employees' Retirement System (PERS) 2% @ 62 (3 year average). Prior PERS membership may affect retirement formula. Employees contribute 11.25% of their salary to PERS on a pre-tax basis. An employee is vested after 5 years of membership. No Social Security is withheld.
